1. Identity of the Artist / Seller

2. Applicability
- These terms and conditions apply to all offers, agreements, and deliveries of artworks (including photography) by Rein Willem Gloudemans.
- Any deviations from these terms are valid only if confirmed in writing.
- By placing an order or entering into an agreement, the buyer acknowledges having read and accepted these terms.
3. Editions and Availability
- All photographs and artworks are sold in limited editions of 8, unless otherwise stated.
- Each print is numbered and signed by the artist.
- Prices vary per edition: the first four (nos. 1–4) are sold at the standard price; the last four (nos. 5–8) are sold at a higher price.
- Each buyer receives a certificate of authenticity stating the edition number.
4. Prices and VAT
- All prices are quoted in euros (€) and include 9% VAT.
- Prices exclude shipping, packaging, and insurance costs unless otherwise specified.
- Rein Willem Gloudemans reserves the right to change prices; such changes do not affect existing orders.
5. Payment
- Payment must be made in advance before production or delivery of the artwork begins.
- For online purchases, payment must be made via the offered payment methods (e.g., iDEAL, bank transfer, credit card).
- Orders will only be processed after full payment has been received.
- In case of non-payment, Rein Willem Gloudemans reserves the right to cancel the order.
6. Delivery and Shipping
- Delivery will take place after full payment has been received.
- Shipping is at the buyer’s risk, unless otherwise agreed.
- Artworks are carefully packaged; any transport damage must be reported within 48 hours of receipt.
- Collection by appointment is possible.
6A. International Shipping and Import Duties
- Orders shipped outside the European Union (EU) may be subject to import duties, customs taxes, and fees imposed by the destination country.
- These additional charges are not included in the artwork’s price or the shipping cost and are the responsibility of the buyer.
- Customs policies vary widely; buyers are advised to contact their local customs office for more information before placing an order.
- Rein Willem Gloudemans is not responsible for delays caused by customs processing or import regulations in the destination country.
- If a shipment is refused due to unpaid customs duties or taxes, the buyer remains liable for all costs incurred, including return shipping and any associated fees.
7. Copyright and Intellectual Property
- All copyrights and intellectual property rights remain the exclusive property of the artist.
- The buyer acquires ownership of the physical artwork only — no reproduction or publication rights are transferred.
- The image may not be copied, reproduced, published, or used commercially without written permission from the artist.
8. Right of Withdrawal (for consumer distance purchases)
- For online purchases, consumers have the right to withdraw from the purchase within 14 days of receipt without giving any reason, provided the artwork is returned undamaged and in its original condition.
- The right of withdrawal does not apply to custom-made or commissioned works.
- Return shipping costs are at the buyer’s expense.
8A. Print-on-Demand Works and Exclusion of Withdrawal Right
- All artworks sold by Rein Willem Gloudemans are produced print-on-demand, meaning each print is made specifically for the buyer after an order is placed.
- In accordance with Article 6:230p sub f of the Dutch Civil Code, the right of withdrawal does not apply to goods that are made to the consumer’s specifications or clearly personalized.
- By confirming the order, the buyer explicitly agrees that the production of the artwork will start immediately and waives any statutory right of withdrawal.
- Once the printing process has begun, the order can no longer be cancelled or refunded.
9. Liability
- Rein Willem Gloudemans is not liable for indirect or consequential damages, or for any loss of profit.
- Any liability is limited to the amount paid for the specific artwork concerned.
10. Force Majeure
In cases of force majeure (including illness, fire, strikes, or transport disruptions), Rein Willem Gloudemans reserves the right to postpone delivery or cancel the agreement without liability for damages.
11. Governing Law and Disputes
- These terms and all related agreements are governed exclusively by Dutch law.
- Any disputes shall first be resolved amicably. If no resolution is reached, disputes shall be submitted to the competent court in the district where Rein Willem Gloudemans is established.
